Terms & Conditions
When placing an order with Oh So Sweet Candy Trees all orders are subject to the Terms and Conditions set out below:
Delivery - Please note: We dispatch orders within 2 working days, please then allow 1 further day for delivery to all UK Mainland locations, (EXCEPT for Scottish Highlands, Offshore Islands and Northern Ireland - for these, please allow 7 working days).
All orders are dispatched via Parcelforce and you will receive a Text Message or Email with confirmation of your delivery date and also on the morning of delivery with a 1 hour delivery time slot, meaning you wont need to wait in all day for your parcel. Please ensure you enter your correct Mobile number and email when ordering.
Oh So Sweet Candy Trees will deliver UK wide. All packages will be sent via a courier service or delivered by our own service vehicles. Whilst all care is taken when packaging goods, should anything in your package be damaged during transit please advise us by emailing info@ohsosweetcandytrees.co.uk within 1 working day of receipt of goods to discuss the next options.
PLEASENOTE: Any orders that are 'returned to sender' due to reasons of customer error, will be refunded minus the delivery fee & will be subject to a restocking fee. The reasons stated below will include a restocking fee of 25% of the goods value once the item/s have arrived back with us:
- The driver attempted to deliver the parcel on several occasions but failed due to nobody being present at the property to accept the parcel.
- The driver attempted to deliver the parcel but failed due to an incorrect delivery address being given at the time of the order.
- The driver attempted to deliver the parcel but the recipient refused to accept the parcel on arrival.
- The driver had an unsuccessful attempted delivery & then left the parcel to collect from the recipient's nearest Post Office but the recipient failed to collect within two weeks.
- The customer notifed parcelforce to delivery to a post office but then failed to collect it within two weeks.
We
send shipping updates and courier notifications via text or email to
alert you of your delivery date and time, if your delivery date is not
convenient please work with the courier by responding to them as you can
change the date of your delivery or request to leave with a neighbour
or a local post office. Parcelforce will automatically redeliver on the
next working day and will leave instructions on how to retrieve your
parcel if the second attempt was unsuccessful.
Returns Policy
If you wish to return any faulty items for a replacement or refund,
please return to the following address: Oh So Sweet Candy Trees, 6 Lowerhouse Lane, Burnley, Lancashire, BB12 6HU and please obtain proof of postage
so we can refund the return costs back to you, please let us know by
email before returning your order.
Please note, any food items or personalised orders will not be returnable due to them being perishable items & or personalised with personal messages which means they cannot be resold so they are not included in our returns policy.
Any damaged products that are of fault of our couriers need to be left as they were delivered to you, please do not discard the packaging box or any of its contents as we will need to see photographic evidence of the damage that has occured which we can forward onto the courier for investigation.
We endeavour to have all orders dispatched within 2 working days of your order being placed once payment has cleared into our account. If/when stocks are low, delivery may be delayed. Delivery of the Goods will be made to the shipping address provided by you at the time you place your order, unless you have since contacted us to change the address before we have dispatched the goods.
Allergies - We cannot guarantee that our sweets do not contain traces of nuts, as we purchase from a variety of suppliers. It is your responsibility to inform all of your guests attending your event that some sweets may contain traces of nuts. All items on the website, have a clear description (please see information tab) of any allergens found in the products along with any colours or sweeteners.
We will endeavour to suit your needs in the ranges of sweets you require including Kosher, Vegetarian and Halal.
Sweet Trees & Chocolate Trees - General Information - Oh So Sweet Candy Trees will endeavour to produce your order to the specifications in the designs chosen and shown on our website, however sometimes due to availability of stock this can alter, but we will design your gift as close to the colour choice chosen.
All items come fully gift wrapped but
occasionally some sweets may drop off in transit and will fall from the
cellophane once unwrapped, if this occurs which is extremely rare, the
sweets can easily be attached back into place, please call us if you
need any assistance. We package our products extremely well for a safe
journey and use a reliable safe next day courier service. Some of our
Sweet Trees are constructed using cocktail sticks, so young children
under 3 years old must be supervised near the Candy Trees. Oh So Sweet
Candy Trees cannot be held responsible for any choking incidents or
allergies that may occur due to our sweets or any equipment used to
construct the Candy Trees.
Cancellations - As our creations are bespoke & created to customers specifications ie. Personalised, and as they contain sweets/chocolate, we do not offer cancellations once the goods have been created & dispatched to you. However, If you decide to cancel your order and notify us (by emailing us at info@ohsosweetcandytrees.co.uk) before we have created & dispatched your items, we will refund your payment and cancel the order - if the order has already been dispatched then we are unable to accept cancellation of an order. Cancellations are at our sole discretion.
Complaints - It is our responsibility to supply you with goods that meet your consumer rights. If you have any concerns that we have not met our legal obligations please contact us with 7 Days of receipt of your order. Privacy Policy - We
are committed to ensuring that your privacy is protected. Should we ask
you to provide certain information by which you can be identified when
using this website, then you can be assured that it will only be used in
accordance with this privacy statement. We may periodically send
promotional emails about new products, special offers or other
information which we think you may find interesting using the email
address which you have provided. We do not store card details, payments are directly processed through our merchant processor Fiserve / Clover.
Security - We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online. We will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so.
Disclaimer Liability - Oh So Sweet Candy Trees cannot be responsible for any products lost, stolen or damaged, once they have been delivered or set up at any event as agreed in advance with you, and we have left the premises. As our products are edible, they are non returnable and have a shelf life of up to 6 months, when stored in an airtight container, unless otherwise stated by us before delivery. All of our photos and design’s are subject to change or availability, but we will always do our best to get the next closest product. You agree to indemnify us at all times in respect of all claims in relation to any loss, injury, claim arising out of or in connection with the use of any products by Oh So Sweet Candy Trees.
These terms and conditions apply to our on-line and events orders. Your order is accepted on the basis that you agree to our current terms and conditions. All sales/orders from our brochure/internet website will be governed according to English law. You’re right by Law in these terms and conditions do not in any way affect your statutory rights. Obligation to supply - we are only obligated to supply you with those goods which: You describe accurately in your order, and are in stock at the time of receipt of your order. Where you do not accurately describe an order to allow Oh So Sweet Candy Trees to work to your exact specifications, we will use our reasonable judgement to supply you with the correct products. Governing Law these Terms and Conditions shall be governed by English Law and shall be subject to the non- exclusive jurisdiction of the English courts.
Limitation of liability - Except as may be implied by law, where the Buyer is dealing as a Consumer, in the event of any breach of these Terms and Conditions by the Seller, the remedies of the Buyer shall be limited to damages which shall in no circumstances exceed the price of the Goods, and the Seller shall under no circumstances be liable for any indirect, incidental or consequential loss or damage whatever. Oh So Sweet Candy Trees shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to, acts of God, strikes, lock outs, accidents, war, fire, failure of any communications, telecommunications or computer systems, breakdown of plant or machinery or shortage or unavailability of raw materials from our suppliers, and Oh So Sweet Candy Trees shall be entitled to a reasonable extension of its obligations.
Oh So Sweet Candy Trees shall be entitled to alter, change, modify & add to these Terms and Conditions at any time, you should check these shop terms periodically for changes. By placing an order through Oh So Sweet Candy Trees after we post any changes to the shop terms, you agree to accept those changes, wether or not you have reviewed them.
